Harlan Ellison / Fantagraphics Settlement Publicly Available

The settlement agreement and release that Harlan Ellison (the Plaintiff) and Fantagraphics (the company and its principals; the Defendants) signed to end their mutual lawsuit is now available on the latter’s web site. The key provisions of the agreement are:
* neither party is paying the other anything;
* the Defendants “shall refrain from making ad hominem, personal attacks on Plaintiff so long as Plaintiff shall live”;
* “Plaintiff shall refrain from making ad hominem, personal attacks on any of the Defendants so long as such Defendant shall live (or be in existence, in the case of a business entity);
* Fantagraphics will remove the two offending passages from their book Comics as Art;
* Fantagraphics will remove Ellison’s name from the cover of The Writers;
* the previously mentioned fact that neither party is at liberty to comment on the case (although they are permitted to post the settlement on the web).
